ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THESE TERMS CAREFULLY.
By using Nearable’s Services, you agree that disputes between you and Nearable Inc. ("Nearable," "We," or "Us") will be resolved through binding individual arbitration, waiving your right to a jury trial or class action. You may opt out of arbitration (see Section 18). By agreeing, you acknowledge reading and understanding these Terms.
1. Acceptance of Terms
These Nearable General Terms of Use ("Terms") govern your use of:

Any mobile applications ("Apps") owned by Nearable.
All related services, content, and features (collectively, "Services").
By registering, browsing, or using our Services, you agree to these Terms and our Privacy Policy. If you disagree, do not use our Services.
Key Agreements:
You are legally authorized to accept these Terms.
You are at least 13 years old (or under parental supervision if under 18).
You will comply with all applicable laws.
2. Services Overview
Nearable operates a job board platform connecting Employers (businesses posting jobs) and Seekers (users applying for jobs). Seekers can create profiles, upload resumes, and apply for jobs. Employers can post jobs.
3. Licenses and Restrictions
3.1 License Grant
Subject to compliance with these Terms, Nearable grants you a limited, non-exclusive license to:
Access and use the Services for personal or internal business purposes.
Download and use our Apps on devices you own.
3.2 Prohibited Actions
You agree not to:
Scrape, copy, or misuse content from Nearable.
Reverse-engineer or disrupt our Services.
Post unlawful, fraudulent, or harmful content.
Impersonate others or share unauthorized information.
4. User Responsibilities
4.1 Account Registration
Provide accurate and current information.
Safeguard your login credentials.
Notify Nearable immediately of unauthorized account use.
4.2 Content Ownership
You retain ownership of content you post ("Your Content").
By posting, you grant Nearable a license to use, display, and distribute Your Content to facilitate job matching.
4.3 Job Postings (Employers)
Ensure job postings comply with all laws (e.g., anti-discrimination, wage transparency).
Do not post misleading, expired, or illegal opportunities.
5. Third-Party Services
Nearable may integrate with third-party platforms (e.g., Google, Apple).
Use of third-party services is at your own risk, governed by their terms.
6. Disclaimers and Limitation of Liability
6.1 "As Is" Services
Nearable provides Services without warranties. We do not guarantee:
Accuracy of job postings or Seeker profiles.
Uninterrupted or error-free functionality.
7. Arbitration and Dispute Resolution
7.1 Mandatory Arbitration
Disputes must be resolved through binding arbitration (not court) administered by National Arbitration and Mediation (NAM).
7.2 Class Action Waiver
Claims must be brought individually, not as class actions or consolidated proceedings.
7.3 Opt-Out Rights
You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@nearable.io.
8. Governing Law and Jurisdiction
These Terms are governed by Delaware law (U.S.).
Disputes not subject to arbitration will be resolved in Delaware courts.
9. Updates to Terms
Nearable may update these Terms. Continued use after changes constitutes acceptance. We will notify users via email or website notice.
